Terms and conditions for the CAFF publication ordering system
Terms and Conditions
The owner and operator of this site is the Conservation of Arctic Flora and Fauna (CAFF). CAFF is a not-for-profit intergovernmental organization. By purchasing documents from CAFF through this website the purchaser (“Customer”), is contributing to the cost of printing the publication and agrees to the following terms and conditions of sale.
1.1 Upon the Customer confirming his/her purchase order, the Customer agrees to purchase the products in the Customer’s “shopping cart” for the stated price, as well as any postage and handling charges as applicable.
1.2 CAFF will send the products to the Customer as soon as practicable after it receives payment for the products. CAFF is a small office and will endeavour to deliver according to manpower and workload capacity.
1.3 The Customer warrants that it will not purchase products for the purpose of commercial resale.
2. Stock availability
2.1 CAFF endeavours to keep publication information and stock availability figures up to date on the website and ordering system. However, if information presented is incorrect, the Customer shall receive the order as best as CAFF is able to complete it.
2.2 If the Customer pays for a product which CAFF cannot supply, CAFF will refund the price of that product to the Customer.
3. Shipping requirements
3.1 It is the Customer’s responsibility to provide CAFF with an accurate, up to date and complete mailing address as required by the mandatory forms on the publication ordering system.
3.2 CAFF will send the Customer’s package according to the Customer’s instructions and options chosen on the ordering system website. CAFF uses Iceland Post as its mail/shipping provide. CAFF is not responsible for shipping charges or delivery times.
3.2 CAFF will provide shipment tracking numbers via email once the package is sent. The day this information is sent via email is considered the day of shipment.
4. Products sent to incorrect address
4.1 If a product is not received by a Customer because it was sent to an incorrect address due to an error by CAFF, then CAFF shall be responsible for the resending or replacement of the product or refunding of the price of the product.
4.2 If a product is not received by the Customer because the Customer provided an incorrect or insufficient address, then:
(a) subject to clause , if the product is returned to CAFF, CAFF will resend the product to the Customer provided that the Customer first pays the cost of postage and handling for resending; or
(b) if the product is not returned to CAFF, then CAFF shall have no further responsibility.
4.3 CAFF is not responsible for lost or stolen packages once submitted to Iceland Post for shipment.
4.4 If the Customer does not receive products it has purchased within 40 days of the date of shipment, CAFF shall not be liable to the Customer for those products unless the Customer notifies CAFF within 40 days of the date of shipment.
5. Non-claimed products
If products which a Customer has purchased are returned to CAFF by a person other than the Customer and CAFF cannot, despite reasonable efforts, contact the Customer or the Customer does not contact CAFF within three months of products being returned to CAFF, then ownership of the products will revert to CAFF and no refunds will be provided
The Customer agrees not to hold CAFF liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.
7. Passing of risk and ownership
7.1 Subject to clauses, CAFF does not accept any liability for products after it has left the CAFF office building.
7.2 Subject to clause 5, ownership of products purchased by the Customer shall pass to the Customer upon CAFF sending the products to the Customer.
8. Limitation of liability
8.1 CAFF shall not be liable to the Customer for refunding the price of products or replacing or exchanging products which the Customer purchases through CAFF’s website other than as set out in these terms and conditions.
8.2 CAFF shall not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use or performance of products or services which the Customer purchases through CAFF’s website, even if CAFF has been advised of the possibility of such damages.
10. Site access
10.1 CAFF hereby grants the Customer permission to access, view and download the content appearing on this site, for personal, non-commercial use only.
10.2 The Customer agrees not to use any device, method or software to interfere with the proper functioning of this site including but not limited to: spiders, robots, avatars, agents, data mining, gathering or extraction tools and attempts to probe, scan or test or breach security and authentication measures.
The Customer’s personal details will not be sold or leased to any third party. CAFF will not use or store this information for purposes other than to complete the order/transaction.
12. Use of materials in reports
12.1 CAFF retains copyright on all printed and electronic documents, reports, videos, websites, DVDs and other products produced by CAFF. All materials for which CAFF holds the copyright are freely-available for non-commercial uses, including press/media use, and use in the production of educational and outreach materials, etc. You are kindly requested to acknowledge CAFF as the source of these materials. CAFF documents, reports and materials may, however, include content (for example photographs, graphics, news items) for which CAFF is not the primary copyright holder and use must be requested through those sources independently of CAFF. 13. Governing law and jurisdiction
These terms and conditions are governed by, take effect and will be construed in accordance with Icelandic law, and the Customer irrevocably and unconditionally agrees to submit to the exclusive jurisdiction of the courts in Iceland and courts entitled to hear appeals therefrom.
